1. Introduction

Welcome to Proferex, operated by Adnovation Technologies LLC ("Company", "we", "us", or "our"). By accessing and using our website at https://www.proferex.com (the "Site") and our affiliate tracking platform (the "Service"), you agree to these Terms of Service ("Terms"). Please read these Terms carefully before using our Service.

Proferex provides an affiliate tracking platform with campaign management, no-redirect tracking, landing page hosting, push notification monetization, blog publishing, and related tools for affiliate marketers.

2. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use the Service.

By creating an account, you represent that the information you provide is accurate and that you are authorized to use the payment method associated with your account.

3. Account Registration and Security

To access the Service, you must create a Proferex account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to notify us immediately of any unauthorized access to or use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are used for purposes that violate applicable laws.

4. Subscription and Payment Terms

Proferex offers a subscription-based service. The current plan is $249 per month, with promotional pricing available for limited periods (e.g., launch specials).

Payments are processed securely through Stripe. By subscribing, you authorize recurring monthly charges to your payment method.

Subscriptions automatically renew each billing cycle unless you cancel before the next billing date. You can cancel your subscription at any time from your account settings.

Promotional pricing (such as the launch special of $124/mo for the first 2 months) applies only for the specified promotional period. After the promotional period ends, the standard monthly rate applies.

We do not offer refunds for subscription fees already paid. Partial-month refunds are not available upon cancellation.

5. Acceptable Use

You agree to use the Service in compliance with all applicable laws and regulations. You are solely responsible for the content of your campaigns, landing pages, blogs, and any other material you create or host through the Service.

You agree not to use the Service to:

- Promote illegal products, services, or activities

- Distribute malware, phishing pages, or other harmful content

- Engage in fraud, deception, or misrepresentation

- Violate the terms of service of traffic sources, affiliate networks, or other third-party platforms

- Infringe on the intellectual property rights of others

- Send unsolicited push notifications to subscribers without proper consent

We reserve the right to remove content or suspend accounts that violate this acceptable use policy without prior notice.

6. Push Notification Monetization

Proferex integrates with Tacoloco for push notification monetization and Notix for push notification delivery.

By enabling push monetization on your campaigns, you agree that visitors to your landing pages may be prompted to opt in to browser push notifications. You are responsible for ensuring this practice complies with applicable laws and regulations in the jurisdictions where your traffic originates.

Push subscriber data is shared with Tacoloco and Notix to facilitate monetization and notification delivery. Revenue generated from push monetization is subject to the terms and payout schedules of Tacoloco.

Proferex is not responsible for changes to Tacoloco or Notix policies, payout rates, or service availability.

7. Landing Page Hosting and Blog Content

Proferex provides hosting for HTML landing pages you upload and for blogs you create within the platform.

You retain ownership of all content you upload or create. By uploading content to Proferex, you grant us a non-exclusive license to host, serve, and distribute that content as necessary to provide the Service.

You are solely responsible for ensuring that your hosted content does not infringe on third-party intellectual property rights or violate applicable laws.

We reserve the right to remove hosted content that violates these Terms or our acceptable use policy.

8. Custom Domains

Proferex allows you to configure custom domains for tracking, landing pages, and blogs at no additional cost.

You are responsible for owning or having proper authorization to use any custom domains you configure with the Service.

DNS configuration for custom domains is your responsibility. We provide documentation to assist with setup.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, available at https://www.proferex.com/privacy-policy.

You are responsible for complying with applicable data protection laws (including GDPR, CCPA, and others) with respect to the campaign traffic data processed through your Proferex account.

10. Intellectual Property

The Proferex platform, including its software, design, branding, and documentation, is the intellectual property of Proferex and is protected by copyright and other intellectual property laws.

You may not copy, modify, distribute, reverse engineer, or create derivative works based on the Proferex platform.

You retain full ownership of the campaigns, landing pages, blog content, and other materials you create using the Service.

11. Service Availability and Modifications

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation.

We may modify, update, or discontinue features of the Service at any time. For significant changes that affect your use of the Service, we will provide reasonable advance notice.

Scheduled maintenance windows will be communicated in advance when possible.

12. Limitation of Liability

To the maximum extent permitted by law, Proferex and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from:

- Your use of or inability to use the Service

- Unauthorized access to or alteration of your data

- Actions or conduct of third parties, including traffic sources, affiliate networks, Tacoloco, or Notix

- Loss of campaign data, tracking data, or push subscriber data

- Changes to third-party platform policies that affect your campaigns

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Our total liability for any claim arising from these Terms or the Service is limited to the fees you paid to Proferex in the 12 months preceding the claim.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved in the courts located in Sheridan County, Wyoming, and you consent to the personal jurisdiction of such courts.

14. Changes to Terms

Proferex reserves the right to update or modify these Terms at any time. We will notify you of significant changes via email or through a prominent notice on the Site.

Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
